By-Laws

 

Enacted on March 07, 2001.  The following By-Laws supersede all existing By-Laws.

In case of conflict, the Ontario Public Service Employees Union’s (OPSEU) Constitution takes precedence over these By-Laws.

 

Last amended on

 

Procedure to Amend the By-Laws

 

 

1.         Give the Secretary written Notice of additions, deletions, changes and / or amendments at least fourteen calendar days prior to a General Meeting.

 

2.         The secretary will serve notice to the membership at least ten calendar days prior to the General meeting of the proposed By-Law changes.

 

3.         The proposed By-Law amendments will then be debated at the next General Meeting.

 

4.         By-Laws amendments require a two-thirds majority of the members present for approval.

 

Mandate of Local 237

 

1.         To perform OPSEU and college roles in a professional manner.

 

2.         To demonstrate positive, pro-active leadership to protect of our memberships’ rights as outlined in the Collective Agreement and Regulatory Acts.

 

3.         To provide confidential service to all members of Local 237.

 

4.         To ensure that Local 237’s views are expressed at OPSEU’s regional and provincial levels.

1.                  All Full-Time professors, counsellors, instructors, and librarians. Full-Time members may opt to work a partial load while retaining their voting rights

 

2.                  Part-Time Partial-Load (6 to 12 contact teaching hours)

- have all voting privileges

- have limited rights under the College Collective Agreement

 

3.                  Part-Time (less than 6 hours) and sessional (unlimited hours) have no signing privileges as stated in the Colleges Collective Bargaining Act (CCBA).

Qualifications

 

All members of the Executive and Officers of Local 237 must be in good standing with

OPSEU in order to hold office. 

 

The Stewards

 

1.                  Are elected / acclaimed by their respective constituencies at a General Meeting

 

2.                  Term of office:

- Two- year term

- Elected in Winter Term (usually March), 2001 to 2003, etc.

- Effective the date of election / acclamation

 

3.                  Vacancies during the Term of Office may be filled at a LEC meeting or at a General Meeting.  For constituencies see page ten

 

4.                  Vacancies within the last ninety days of office may be appointed by the President of the Local

2.                  Vacancies during the Term of Office may be filled at a LEC meeting or at a General Meeting.

The officers are elected / acclaimed / appointed from the Local Executive Committee (LEC).  The positions are President, Vice President, Chief Steward, Secretary, and Treasurer.

- Maintaining and / or delegating responsibility for Local 237's web          site

- Delegating responsibilities for maintaining current local membership     lists, committee membership lists, mailing lists, etc,

       > resolving SWF disputes which may arise

       > informing all overtime claimants of their rights and due process

 

- Adherence to the Collective Agreement

- Processing all grievances in conjunction with the

   President / Stewards

- Advising the stewards on dispute resolution mechanisms

- Informing the executive on all pertinent precedent setting grievance         and arbitration awards

- Awareness on related Provincial changes to legislation and                       arbitration awards effecting the membership

- Check endorsements (2 of 4 signatures required)

THE STANDING COMMITTEES

 

Faculty Agreement Committee - F A C  (Collective Agreement, Article 7)

 

The FAC is the same as the Union / College committee (Local) as stated in the Collective Agreement.  However, four members are appointed by The Local Executive Committee as opposed to three as stated in the Collective Agreement.

FINANCES

 

Membership Dues

 

Union dues are automatically deducted by payroll and submitted to OPSEU Head Office

All  Full-Time academic employees, Partial-Load faculty pay dues.

Sessional and  Part-time academics do not pay dues.

 

OPSEU dues are deducted at the rate of 1.325 % of salary.  The rebate formulae are found in Section 15.4 of OPSEU’S Policy manual.  OPSEU rebates to the local on the basis of  signed members only.

 

Local 237's dues assessment is $3.00 dollars per month per dues paying employee and is deducted from source on a monthly basis.

Grants, Bursaries and Charities

 


1.                 That the Local Executive Committee (LEC) approve all Grants, Bursaries, Charities, etc. with the exceptions noted below.

 

2.                 That financial requests made at a General Meeting must be referred to the LEC for consideration at its next scheduled meeting.

 

3.                 That Local 237 support United Way's annual campaign to a cost of One Dollar per member.

 

4.                 That other college_wide faculty functions and college_wide faculty interests be funded to a maximum rate of One Dollar per member as approved the LEC.

 

5.                 That members' health issues, bereavements, etc., be funded to a maximum of Fifty Dollars ($50.00) per issue. Additional costs may be approved by the Faculty Agreement Committee (FAC).

 

6.                 That we support an annual Canadian Labour Relations award(s) to a maximum of Five Hundred Dollars ($500.00) total, and that the Local Executive Committee determine award criteria.

 

7.                 That other student awards, bursaries, etc., be funded to a maximum of Seventy Five Dollars ($75.00) as approved by the LEC.

 

8.                 That we support other striking locals to a maximum expense of Twenty Five Dollars ($25.00) per issue.

 

9.                 That other financial requests must be of a college wide interest for the LEC to give its consideration.

 

10.             That all approved Grants, Bursaries and Charitable donations be tabled at the General Meetings as part of the Treasurer's report.
